These Terms of Use (“Terms”) govern your access to and use of the website operated by CadTechStore Australia (“CadTechStore Australia”, “we”, “us”, or “our”). By accessing or using our website, creating an account, or placing an order, you agree to be bound by these Terms in full. If you do not agree, you must not use the website.

Please read these Terms carefully before using our website or purchasing any products. These Terms constitute a legally binding agreement between you and CadTechStore Australia. By completing a purchase, you confirm that you have read, understood, and accepted these Terms.

1. Definitions

“Website” refers to all web pages, content, and services available at the domains operated by CadTechStore Australia for the sale and promotion of GstarCAD software products.

“Products” refers to software licenses, support packages, and any related digital goods or services offered for sale on the Website.

“Customer”, “you”, or “your” refers to any individual or legal entity accessing the Website or purchasing Products.

“Account” refers to the registered user profile created during checkout or via the registration process on the Website.

“License” refers to the right to use a software product under the terms specified by the software publisher’s End User License Agreement (EULA).

2. Eligibility

You must be at least 18 years of age to use this Website, create an Account, or place an order. By using the Website, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

If you are acting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

You may create an Account during the checkout process. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.

You agree to provide accurate, current, and complete information during registration and to keep your Account information up to date. CadTechStore Australia reserves the right to suspend or terminate any Account that contains inaccurate information or is used in violation of these Terms.

You must notify us immediately using the contact details provided on the Website if you become aware of any unauthorised use of your Account.

4. Products and Licenses

CadTechStore Australia is an authorised reseller of GstarCAD software products. All software licenses purchased through the Website are subject to the software publisher’s End User License Agreement (EULA), which governs your use of the software itself.

We offer various license types, including but not limited to perpetual licenses, subscription licenses, and network licenses. The specific terms and limitations of each license type are described on the relevant product page.

Demo versions of Products may be made available for evaluation purposes. Demo versions are provided "as is" and may have limited functionality or a restricted evaluation period as specified on the Website.

5. Orders and Pricing

All prices displayed on the Website are in the currency indicated and include or exclude VAT as stated. For customers within the European Union, applicable VAT will be added at checkout in accordance with current legislation.

Placing an order constitutes an offer to purchase. A binding contract is formed only when we confirm your order via email or when the Product is delivered, whichever occurs first. We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, pricing errors, or suspected fraud.

We make every effort to ensure pricing accuracy. In the event of a manifest pricing error, we will notify you and offer the option to confirm the order at the correct price or cancel it for a full refund.

6. Payment

We accept the following payment methods:

Credit or debit card — processed securely via a PCI-compliant payment provider
PayPal
Stripe — secure online card payments
Bank transfer — direct deposit to our business account

Payment is due at the time of purchase for card and PayPal transactions. For bank transfers, the order will be processed upon receipt of funds. If payment is not received within 14 days of the order date, the order may be automatically cancelled.

All payment processing is handled by third-party payment providers. CadTechStore Australia does not store your full credit card details. Your use of third-party payment services is subject to their respective terms and privacy policies.

7. Delivery

Software licenses are digital products. Upon successful payment and order confirmation, license keys and download instructions will be delivered to you electronically via email and/or your Account dashboard.

Delivery is typically immediate for card and PayPal payments. For bank transfers, delivery occurs after payment has been received and verified.

8. Right of Withdrawal

For customers in Australia and New Zealand, your rights in relation to refunds and cancellations are governed by the Australian Consumer Law (ACL) and, where applicable, the New Zealand Consumer Guarantees Act 1993 (NZCGA).

Digital content and change-of-mind

Because our Products are delivered as digital content (software license keys and downloads), once a license key has been issued or a download has started, we generally cannot offer a change-of-mind cancellation or refund.

This does not affect any rights you may have under the ACL or NZCGA. If a Product is faulty, not as described, or otherwise fails to meet a consumer guarantee that cannot be excluded, you may be entitled to a repair, replacement, or refund, depending on the nature of the problem.

If you believe you are entitled to a refund or other remedy, please contact us using the details provided on the Website before uninstalling or ceasing to use the Product. We will assess your request in line with our legal obligations in your country of residence.

9. Support Services

CadTechStore Australia offers various support packages for purchased Products. The scope, availability, and duration of support services depend on the specific package purchased and are described on the relevant product or support page.

Support is provided during business hours and in the languages specified on the Website. CadTechStore Australia reserves the right to modify support offerings, provided that any changes do not diminish the support services already purchased by existing customers for the duration of their active support term.

10. Contact Forms and Communications

The Website provides contact and demo request forms for inquiries, support, and product demonstrations. By submitting a form, you consent to CadTechStore Australia processing the information you provide for the purpose of responding to your inquiry and, where applicable, for customer relationship management.

Submitted data is processed in accordance with our Privacy Policy and may be stored in third-party systems (Brevo for email communications and Intrix CRM for customer management) that are used by CadTechStore Australia to handle inquiries and maintain customer relationships.

11. Intellectual Property

All content on the Website — including but not limited to text, graphics, logos, images, software, and design — is the property of CadTechStore Australia or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Website without prior written consent from CadTechStore Australia, except as necessary for your personal, non-commercial use of the Website.

GstarCAD and related product names, logos, and trademarks are the property of Gstarsoft Co., Ltd. and are used by CadTechStore Australia under authorisation.

12. Prohibited Conduct

When using the Website, you agree not to:

Provide false or misleading information in forms, orders, or Account registration

Use the Website for any unlawful purpose or in violation of applicable laws

Attempt to gain unauthorised access to any part of the Website, other user accounts, or our systems

Interfere with or disrupt the operation, security, or integrity of the Website

Use automated tools, bots, or scrapers to access the Website without prior written consent

Resell, redistribute, or sublicense Products purchased through the Website unless expressly authorised

13. Limitation of Liability

To the maximum extent permitted by applicable law, CadTechStore Australia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of the Website or purchase of Products.

Our total liability for any claim arising from these Terms or your use of the Website shall not exceed the total amount paid by you to CadTechStore Australia for the specific Product or service giving rise to the claim in the 12 months preceding the event.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

14. Disclaimer

The Website and all Products are provided "as is" and "as available" without warranties of any kind, except as expressly stated in these Terms or as required by mandatory applicable law.

CadTechStore Australia does not warrant that the Website will be uninterrupted, error-free, or free of harmful components. We make reasonable efforts to ensure the accuracy of product descriptions and pricing but do not guarantee that all information is complete or current at all times.

As a reseller, CadTechStore Australia does not develop the software products and is not responsible for defects, bugs, or limitations inherent to the software. Software-related warranties, if any, are governed by the publisher’s EULA.

15. Third-Party Services

The Website may contain links to third-party websites or integrate third-party services (including payment processors, analytics, and communication platforms). CadTechStore Australia is not responsible for the content, privacy practices, or terms of any third-party services.

Your use of third-party services is at your own risk and subject to the respective third party’s terms and conditions.

16. Termination

We may suspend or terminate your access to the Website or your Account at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

Upon termination, your right to use the Website ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — shall remain in effect.

Termination of your Account does not affect the validity of software licenses already purchased and delivered, which remain governed by the applicable EULA.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia, and, where applicable, the mandatory consumer protection laws of New Zealand, without regard to conflict of law principles.

For customers located in Australia, you agree that any disputes arising from or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia. For customers located in New Zealand, disputes may be brought before the competent courts of New Zealand.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993 (NZCGA), to the extent those laws apply and cannot be excluded by agreement.

18. Changes to These Terms

CadTechStore Australia reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Material changes will be communicated via email or a prominent notice on the Website.

Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Website.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
